Willow Creek Architectural Change Request Guidelines
Objective: To provide Willow Creek Homeowners with guidelines and information necessary to request changes or improvements to their property with the purpose of maintaining the architectural integrity of the community, thus ensuring the value we all enjoy as property owners in this community. Important Note:
No work should be contracted or started without the board’s written approval. Work started and or completed without Board approval will result in penalty and the changing of, or removal of such as called for in Article V of the Declaration Covenants, Conditions and Restrictions for Willow Creek.
An assessment of $500.00 will be attached to the property in violation of this policy. A written notice of thirty days will be given to the property owner to correct the violation. If not corrected within 30 days of notice, an additional assessment of $25.00 per day will be made until the correction is made. There will be no exceptions made to this policy.
General Guidelines:
1. Approval is required for anything that changes the current exterior appearance of the structure or property.[1] This includes any enclosure, home-siding, changing of window size or type, all exterior doors, roof color, exterior paint color, decking size, stair replacement, concrete pads, walkways, etc. Also includes landscaping changes that could impact the performance of yard maintenance or its cost to all Willow Creek homeowners.
2. All requested changes to any property must be submitted to the Willow Creek Board of Directors-Architectural Control Committee. All requests must be in writing with complete description of change requested. All requests must be submitted to the board ten days prior to the next scheduled Board meeting, mailed to the Willow Creek HOA, P.O. Box 482, North Myrtle Beach, SC 29597.
3. The Board or Committee will review and provide approval, request additional information, and or disapproval within forth-five days of meeting date.
4. If requested change involves new construction of any type; complete drawings must be submitted showing the existing structure, position and dimensions of any change. List all materials that will be used, including product names, and or manufacture, with color charts, brochures or samples if possible.
5. An approved request for change requires project completion within 120 days from approved date, or as otherwise specified and approve by the Board.
Additional Requirements and Suggestions:
· Provide as much detail as possible with plans that are submitted. If the board does not have enough information to make an informed decision, approval will not be granted until the needed information is provided. This causes at least a 30-day review delay for the homeowner.
· Following board approval, if applicable, all state, local building permits must be obtained prior to the start of work. Failure to due so could result in additional monetary fines, the halt of construction, removal of construction or all of the before mentioned as deemed necessary by ruling city authority.
· No request will be considered that calls for the change in anyway to the basic design or current roof footprint of the home.
[1] Failure to seek approval and to maintain the property including external design to the established standards as deemed by the Board will result in action as called for in Article V of the Declaration Covenants, Conditions and Restrictions for Willow Creek. Also see Important Note Above.
